Freelance in the Russian Federation are going to legalize

    The State Duma of the Russian Federation intends on October 16 to consider a bill on remote work, which will make the necessary changes to labor legislation for cases of "remote" work. The press service of the Ministry of Labor and Social Protection, which developed the bill, explained that auditors, accountants, lawyers, translators, designers, programmers , editors and journalists will fall under the concepts of a freelancer .

    What are you going to accept? First of all, the employer will be required to conclude a formal employment contract with the freelancer; at the same time, the contractor will be subject to the same rights and obligations as ordinary workers. Also, the concept of “remote workplace” will be introduced in the Labor Code of the Russian Federation, some features of certification of such jobs, the regime and labor protection will be described. It is indicated that the freelancer, concluding an employment contract, will be able to provide all documents in electronic form, avoiding the usual mail services.

    One of the problems of distance labor is the difficulty of documenting. The bill proposes to establish the possibility of using an enhanced qualified electronic signature when drawing up an electronic contract of employment where signatures of the parties are required. The employer will be required to send the remote employee a duly certified copy of the employment contract by registered mail with a notification no later than three calendar days from the date of conclusion of the employment contract

    An employee performing work outside the employer's location will distribute his working time and rest time at his discretion, unless otherwise provided by the employment contract. In all other aspects, including guarantees of labor legislation, the employee will have the same rights as any other employee of the employer.

    Back in February last year, Russian President Dmitry Medvedev announced the need to expand opportunities for remote work of citizens. From some reviews it follows that almost 40% of Russians would like to work remotely and independently plan their work schedule.
