    Due to the enactment of the Law of the Republic of Kazakhstan “On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on Intellectual Property Issues”, the popular torrent trackers of Kazakhstan stopped working, Zakon.kz reports.

    Now, according to new amendments to the Criminal Code of the Republic of Kazakhstan, the illegal use of objects of copyright or related rights by organizing, creating Internet resources for further access to the exchange, storage, transfer of copies of works or objects of related rights in electronic digital format, which caused significant damage, is punishable by a fine in the amount of 600 to 800 MCI (from 970,800 tenge to 1,294,400 tenge), or by engaging in community service for a period of 200 to 240 hours, or by limiting freedom for a period of up to 1 year.

    If these acts are committed repeatedly, by a large group of persons by prior conspiracy or by an organized group, cause large damage or are committed by a person using their official position, then this is already punishable by imprisonment for a term of 2 to 5 years with or without property confiscation her.

    Three departments will immediately monitor the implementation of the law - the Ministry of Justice of the Republic of Kazakhstan, the Ministry of Internal Affairs of the Republic of Kazakhstan and the Financial Police.

    Sellers and buyers of counterfeit goods (disks, books, or other objects of copyright or related rights) will also have a hard time - for the purchase, storage, transfer or manufacture of counterfeit copies for marketing purposes, committed in significant amounts shall be punishable by a fine in the amount of 500 to 700 MCI (from 809,000 tenge to 1,132,600 tenge), or by engaging in community service for a period of 180 to 240 hours, or by limiting freedom for a period of up to 1 year.

    Also, amendments were made to the Code of Administrative Offenses of Kazakhstan. For illegal use of objects of copyright or related rights, that is, the acquisition, storage, movement or manufacture of counterfeit copies (except for use on the Internet) for marketing, attribution or co-authorship, if these actions do not contain signs of a criminal offense, entail a fine for individuals in the amount of 10 to 15 MCI (from 16,180 tenge to 24,270 tenge), for officials - in the amount of 20 to 30 MCI (from 32,360 tenge to 48,540 tenge), for legal entities - in the amount of from 100 to 150 MCI (from 161,800 te n 242 700 tenge) with confiscation of copies of objects of copyright and (or) related rights, as well as objects, which were the instruments of the offense.
