    03/26/2019 MPs voted in favor of the adoption of laws in defense of“ Copyright ”. Articles 11 (as article 15) and 13 (as article 17) were adopted in full (348 for, 274 against, 36 abstained). All attempts by opponents of the law to introduce numerous amendments to the discussion have failed. Everything went much faster than planned. At a time when opponents of the law are talking about a black day for the Internet, its supporters celebrate victory.

    Within two years from the date of adoption, the above articles should be integrated into the national legislation of the EU countries.

    And what about Russia?


    Yesterday, March 25, 2019, one of Germany’s leading newspapers, Frankfurter Allgemeine Zeitung (FAZ), published an article entitled “ Altmaer donates startups in favor of copyright ”.



    The article is authored by the editor of the Law and Taxes section, Mr. Hendrik Widuwilt, talking about the following: The

    Minister of Economics and Energy of Germany, Mr. Altmaer, has concluded an agreement with his French counterpart that the scope of the copyright protection law is starting act on companies with an annual turnover of more than 3 million euros, and not from 20 million, as was planned by the German side. As a response, the French should not impede the construction of Nord Stream 2.

    This article focuses more on publishers, news agencies, and other creators of textual content, rather than end users.

    Google & Co uses extracts from other people's articles (snippet) in their news feed, consisting of a picture, a title and the first few sentences. According to the authors of the bill, this information is sufficient for many users, and in no way motivates them to click on the link. Thus, Google users received the necessary information, in other words, received the service without paying for it. Text content creators are encouraged to start negotiations with Google & Co in order to monetize the display of links, i.e., impose a tax on links. It is curious that this law has existed in Germany since 2013. After the introduction of this law, German publishers themselves refused to use it, so on proposals to discuss the conditions for the implementation of the law, Google offered to remove links in response. This ended the discussion. Much sadder ended the introduction of such a law in Spain. Here the discussion entailed the removal of the news page from the Spanish Google, after which the Spanish media missed from 10 to 15% of visitors.

    Adopted article 11 should not limit the placement of links by private users and non-profit organizations. True article does not describe the nuances of use. Is the link hosted, for example, on Twitter or Facebook, private or commercial? How various platforms will respond to this law, one can only guess, maybe someone will have to pay for the placement of other people's links on their portal.
