Negotiations Russians have nowhere to write

    According to the “Spring Package”, from July 1, 2018, telecom operators, Internet services, messengers and other information dissemination organizers are obliged to begin recording and storing conversations and text messages of Russian users. But the operators had a problem: they could not fulfill the requirements of the law due to the lack of certified equipment .

    The newspaper "Kommersant" tried to findlist of certified equipment for the implementation of anti-terrorism laws of the Russian Federation. And it turned out that at the moment such equipment is missing. “At present, there are no certificates of conformity for technical means of accumulating voice information for operational investigative activities in the system of certification in the field of communications,” the press service of Rossvyaz officially announced on July 2, 2018.

    For the sake of execution of the law, operators could use non-certified equipment, but for this they face administrative liability, the Ministry of Communications said to the Association of Telephone Operators (ATN). Thus, the recording of telephone conversations and text messages of all Russians is postponed at least until the end of 2018.

    The Association of Telephone Operators sent a letter to the Ministry of Communications asking them to clarify what equipment can be used to enforce the law. The Ministry of Communications and Mass Media answered that seven companies can undertake the manufacture of such equipment:

    • "Norse-Trans"
    • "Citadel",
    • "Tech Argos Special Systems",
    • "Special Technologies" (renamed "Orion"),
    • "MFI Soft",
    • "Signature",
    • "Basis Lab".

    At the same time, the Ministry of Communications and Mass Media found it difficult to answer which of the listed companies were certified by redirecting this question to Rossvyaz, and the latter answer is quoted above. No one has yet passed certification.

    The certification procedure is not easy, the newspaper writes. The fact is that only one structure has accreditation for testing equipment - a testing center for certification and metrology of the Central Research Institute of Communications. But he can not issue certificates.

    Thus, the certification procedure is delayed until about the end of the year, and after that a certain period of time is required to set up production in the required volumes, and then install the equipment in the data centers, check everything - and start recording.

    Lawyers of mobile operators hope that until the end of certification, the Ministry of Communications will not check operators for compliance with the “Spring Act” and penalize it for non-compliance, because it looks illogical in the absence of certified equipment.

    “Kommersant” recalls that the same paradoxical situation developed in 2014, when the Ministry of Communications and the Federal Security Service demanded that Internet providers record user traffic for 12 hours in a “ring buffer”. But the certification test technique did not appear immediately, so the operators did not install the appropriate equipment for a long time.

    According to experts, in the near future, the Ministry of Communications and Mass Communications will send an order to the Ministry of Justice to cancel, from January 1, 2019, the requirement to store user traffic for 12 hours in a circular buffer. Companies purchased equipment worth hundreds of millions of rubles, but now it will become unnecessary. Now we need to buy other drives and storage systems.

    In the absence of certified equipment, operators are not even able to accurately assess how much it will cost them to comply with the law in order to lay these costs in the budget and calculate the necessary increase in tariffs for subscribers. According to a preliminary estimate of MTS, the cost of implementing the law will amount to 60 billion rubles for the next five years, Megafon - 35-40 billion, and VimpelCom - 45 billion. Amounts may vary depending on what kind of equipment configuration and what requirements to its manufacturers will be approved. “So far, no one knows in what form the state will request from market participants the implementation of the requirements of the law. It is one thing if a phased order is adopted, say, for three years. A completely different scenario, if you need to ensure full compliance in, say, several months, ” saysLinxdatacenter CEO in Russia Olga Sokolova.

    Thus, at present, the law of Spring on the mass recording of all voice and text traffic is not observed. Operators are only testing these systems together with partners who expect to get certified in the near future. The severity of the laws is compensated for by the necessity of their implementation.
