Google and patents: what can be done better?

    Current situation:

Google lost auction for patents to Nortel alliance of other key players; Ahead is an even larger auction for InterDigital patents.

Google understands that it will continue to be difficult to compete for patents with alliances, which poses a great danger to the development of Android.

Google itself claims that the software patent system has discredited itself, but continues to play by its rules and so far loses.

    Causes:

“One who does not think about distant difficulties will face near troubles”

    • Software patents have long discredited themselves - it’s impossible to create anything without violating them, but they are used for unfair competition

    • The risk of a successful alliance against Android has been visible for a long time, and will not get better.

    • The strength of Google is to go our own way, change the status quo for the benefit of everyone, and benefit from it ourselves.

    • But Google decided not to go their own way, but to play by the rules of the existing system, which he himself considers unfair - in the end, loses.

    What can be done better?

We argue - you need to change from the inside:

It is necessary to change the system of software patents.

But changing the patent system legislatively is unrealistic: for a very long time, a lot of interests are tied.

Therefore, you need to destroy it from the inside, not trying to change it formally.

This is exactly what Google suits: the path of the startup from which it grew; the availability of resources and weight, which will obviously come in handy; The strategy and reputation of the “corporation of good”.

A possible solution is to create a community:

Within the existing patent system, create a community in which the current system simply will not operate and ensure its growth until it grows throughout the system.

That is, create a community that:
    • Protects its members from outside patent attacks

    • Protects them from attacks on each other

    • Encourage existing members to invite new ones, and new members to join

    Community Guidelines:

    • Participants put their patents in a common piggy bank

    • Members do not attack other members and neutral external players

    • The community helps participants protect themselves from external attacks - it attacks itself, helps financially

    • Participants finance the community depending on their capabilities - participation is free for small companies

    • You can join the community very quickly.

    What would happen:

    • The community would quickly occupy a large part of the market, because the more powerful it is, the more profitable it is.

    • More fair rules inside: for example, domestic patents are quick to register, with more competitive rules and a very short validity period

    • The basis for changing the formal system - patents would discredit themselves, a very influential player would appear

Can this be done? Yes, especially for Google

You need to do it - the need for change will only grow. All startups seem complicated and impossible, and Google startups can do it. And the scale is right - Google has long been more than just software. And under a worthy idea, there will always be worthy believers
