FAS obliges RU-CENTER to return illegally received 239360212 rubles

    According to the results of the next meeting on the consideration of the distribution of domain names in the domain.RF, the Commission of the Federal Antimonopoly Service decided to terminate the consideration of the case in respect of all persons involved, except for CJSC RSIC and ANO RSIC. In the actions of the above-mentioned legal entities, the commission found a violation of part 1 of article 11, part 3 of article 11 and part 1 of article 14 of the Law on protection of competition and decided to oblige CJSC RSIC to transfer illegally obtained income in the amount of 239 360 212 rubles to the budget of the Russian Federation.

    The FAS found that RU-CENTER violated the law by concluding partnership agreements with other market players before opening the Cyrillic domain zone, which allowed the company to exceed the limit of 4800 domain requests per hour from one registrar. The results of domain auctions held by the registrar may be challenged or canceled.

    In April, the antimonopoly service already fined Ru-Center 600 thousand rubles for obstructing the investigation. All materials of the current investigation of the FAS will be transferred to law enforcement agencies relevant materials to resolve the issue of initiating a criminal case. Since on March 16, 2011 the RBC group of companies acquired CJSC RSIC, the payer of the fine and the beneficiary of the “ serious synergistic effect ” will most likely be OJSC RBC.
