Belgian group wins trial against theater that violates Creative Commons license

CC BY-NC-ND license validity confirmed. Group Lichôdmapwa won a court in the theater company from Brussels, which is a commercial manner without attribution using recycled song of advertising. One of the members of the group heard their song on the radio and wrote to the company, but it did not work out and the parties met in court.

The court acknowledged that the terms of the license clearly stipulate that the song 1) cannot be edited, 2) cannot be used for commercial purposes, 3) should be published with attribution. This destroyed the defense’s allegations that they were not warned about the conditions - they were very clearly stated on the website from which the song was downloaded . For each violated condition, the group will be paid 1,500 €.
