Traumatic and the right of a citizen of Ukraine to self-defense with weapons in their hands

    I don’t know if such materials have the right to live in Habrahabr, but I decided to express my protest not so much about the passionate love for weapons or the desire to possess them, but about the documented inequality of rights of Ukrainian citizens.

    The Constitution of Ukraine has the highest legal force and not one normative legal act cannot contradict it. The Constitution states that “a person, his life, health, honor and dignity, integrity and security are considered the highest social value in Ukraine” (Article 27) and enshrines everyone ’s right “to protect their life and health of other people from unlawful encroachment” (Article 27). According to the Constitution, “citizens have equal constitutional rights and freedoms and are equal before the law”(v. 24).

    The Criminal Code of Ukraine establishes the concept, essence and signs of necessary defense as a circumstance that excludes the crime of an act (Article 36), securing constitutional rights and excluding criminal liability in case of adequate self-defense of a citizen from illegal encroachments.

    Declarative norms sound beautiful and encouraging, but this is where their beneficial effect, unfortunately, ends.

    Even one of the key law enforcement agencies, namely the Ministry of Internal Affairs of Ukraine, violates the constitutional rights of its citizens. What is the secret order of the Ministry of Internal Affairs of Ukraine No. 379 - DSP, which, firstly, violates the right of citizens to information, and secondly, they are discriminated against on the basis of a certain "feature", dividing everyone into "mere mortals" and "a special category of citizens ". There is nothing secret in the order of the Ministry of Internal Affairs of Ukraine No. 379, except for the list of persons entitled to acquire traumatic weapons. So why is he already labeled chipboard !?

    We will not talk about the right of law enforcement officers to active defense means (traumatic weapons), they are supposed to use weapons for a long time and there is no arguing with that. The same can be said of the military, they also do not live sweetly.

    And now let's figure out how we, “mere mortals,” differ from those mortals who are “special” !?

    Special category No. 1. People’s Deputy of Ukraine . These are special people, we have as many as 450 people. White bone, "elite" - how can they forbid something, because they themselves write the laws !? It is true that over 10 years the Law “On Weapons” could not be adopted, thereby giving rise to many “holes” in the legislation and abuses by “permissors”.

    Special category No. 2. Civil servants with categories and grades are at least department heads, i.e. obviously not ordinary citizens. They became "special" because this is required by "corporate ethics."

    Special category number 3. JournalistsUsually the people are simple and quite intelligent. They have nothing to do with the first two categories, with the exception of one BUT! All "special" categories, like any of us, belong to the genus "Homo sapiens", with all the ensuing consequences. A trick that takes into account the psychology of people in action. “If I can, but not to others, then I can always reasonably explain that this is right.” Therefore, the press is silent and the very concept of a “special category” is usually not repulsive or indignant among journalists. After all, how nice it is to be "special"!

    Special Category 4. W Lena social groups to protect public order and the state border.It’s necessary to live like that, but there are a lot of people who want to get permission to purchase among those who are not so “special”. So they left a loophole just in case, it suddenly comes in handy.

    Thus, almost everyone who could at least somehow influence the decision to grant the people of Ukraine the right to self-defense with traumatic weapons in their hands is “covered up” (they are “special”) and they will prove with foam at the mouth that people should not be given weapons. They have zero motivation. In addition, one should not forget that the deputies do not have serious grounds for lobbying for the adoption of the Law of Ukraine “On Arms”. The largest plant for the production of traumatic weapons has not yet been privatized, and it is not customary to defend state interests among deputies.

    Summarize.

    What do we simple, law-abiding and respectable citizens have in the end? What are our chances to achieve the right to self-defense, even with traumatic weapons in our hands !? The answer is simple - there are NO chances, we WILL NOT GET the right, save money and become “SPECIAL” if you want!
