Rights holders is not too happy with, and a number of companies planning to seek Rutracker.org domain blocking, write "News" and Torrentfreak. The National Federation of the Music Industry, which includes Sony Music, Universal Music, Warner Music and other labels, is planning to do this.
“There is a fundamental decision that we will seek the separation of the RuTracker.org domain. Lawyers choose the way how it is most convenient to do. For example, through the court. We choose where it’s cheaper, where it’s faster, etc., ”said Leonid Agronov, Director General of the National Federation of the Music Industry.
Blocking resources that illegally distribute copyrighted content is not an effective method. And the copyright holders are not very happy, as mentioned above, although they believe that in many cases blocking can significantly reduce the audience of the blocked resource.
“We saw that the locks work, although not 100%. We have information that blocking is removed from 50% to 70% of visitors. Criminal activity continues. Therefore, we move on to the next step - domain partitioning. We do not exclude the criminal prosecution of the owners of the resource, ”Agronov comments on the situation.
As for the representatives of Rutracker himself, they do not agree with Agronov’s opinion, and do not believe that the copyright holders have a reason to disaggregate the resource domain. “We see no reason to disaggregate the rutracker.org domain, it is registered in accordance with the registrar's rules, information about the domain owners has been verified and confirmed,” the Rutracker press service said.
As for ICANN, the organization that manages the address space on the Web, it does not have the ability to block domains. “ICANN can only“ warn ”the relevant registrar (registry) of violations and, as a last resort, deprive them of accreditation. This is rare (in relation to registrars), but it happens, I, however, have never heard that this was related to copyright issues. Of course, this takes into account that there are virtually no ways to combat the “mirrors” - the site may “move” to some national (two-letter) domain, to which ICANN certainly cannot have any relation. At the same time, following the “general rules” does not exclude the possibility of any other decisions being made by registrars and registries themselves, ”said Mikhail Yakushev, ICANN Vice President.
According to Anton Sergo, Doctor of Jurisprudence, each domain name registrar should have its own reasons for the separation of the domain. And here "the task for the copyright holder is to try to find these grounds and make sure that he performs this procedure," said Sergo. Nevertheless, this task is very difficult.
The battle between copyright holders and pirates is still far from over - all this, apparently, will continue for a very long time.
