Megaphone, roaming and rake: the usual thing with an unusual end
The story about Megaphone, roaming and ... in fact, that’s all said.
This story began in late July, when I decided to go on vacation to Ukraine through Belarus, from my native St. Petersburg. Having changed my operator from Megafon to Tele2 a couple of years ago, I left the SIM card of Megafon and periodically threw 100-300 rubles on it, with the configured redirection to Tele2. Unfortunately, Tele2 does not work outside of St. Petersburg and the region, so I decided to use the megaphone number, threw money on it to a balance of about 500 rubles, and drove off.
A day later, somewhere in the territory of Belarus, I receive an SMS from Megafon:
“The Roaming service is temporarily suspended. Roaming will be connected automatically with a balance of more than 1,500 rubles. References * 101 # ". Well, actually, that's all! There is no connection at all, proposed * 101 #naturally not to dial.
A few ... um ... surprised at this development of events, having arrived home, the first thing I go to the operator’s office. There they show me the conditions for the provision of roaming, and specifically paragraphs 6 and 7 . Here they are:
6. Due to the technical features in the provision of the Roaming service, as well as the features associated with inter-operator payments for the Roaming service, the Operator reserves the right to partially limit or completely suspend the provision of the Roaming service.
7. To use the Roaming service, the Operator recommends maintaining the balance of the Subscriber's personal account at a level of at least 1,500 rubles.
To my question, do they see the difference between “recommends” and “obliged”, of course, there is no answer. Well, I am making a complaint to them ( unfortunately, I did not save the text of the claim ).
After almost two months, the phone rings from Megaphone. A sweet girl justifies the trip ... by the actions of the security service. Like, under the terms of the provision of roaming, they have the right to do so, and although “an error has occurred”, they do not agree with the viciousness of this idea. Well, I expect a written response from them.
And here he comes, Answer :
It turns out that spending 144 rubles a day in roaming (with an initial balance of about 500 rubles) is already enough, from the point of view of Megafon, to disconnect communication. Yes, not just like that, but "in order to comply with your interests to prevent the occurrence of debt on the account." Here they are, these suspicious waste: even more struck by this approach, write a complaint to the Roskomnadzor with the request to check for compliance with the laws of such practices. And here comes the answer: In short, Megafon, by his actions, violated one clause of the federal law, one clause and one clause of the license terms, as well as five clauses of the rules of the Government’s decree. For which an administrative case was opened under Article 14.1 of the Code of Administrative Offenses (
Carrying out entrepreneurial activity without state registration or without special permission (license) ), part three:
3. Carrying out entrepreneurial activity in violation of the conditions provided for by a special permit (license) - entails a warning or an administrative fine on citizens in the amount of one thousand five hundred to two thousand rubles; for officials - from three thousand to four thousand rubles; for legal entities - from thirty thousand to forty thousand rubles .
In addition, an order was issued to eliminate the identified violations.
So Megaphone habitually stepped on a rake with roaming. Only now they got it not on the forehead, but on the back of the head. :)
In fairness, it should be noted: calls from Megafon representatives were polite, and the minus was removed from my account, as well as they gave me a bonus of 50 points (which, however, I did not activate anyway).
