Google in Ukraine failed to defeat the cybersquatter. For now

    Despite the presence of a court decision, Hostmaster is in no hurry to stop delegating the google.ua domain name, which at the moment belongs to GOU OGLE LLC.

    On June 16, 2010 the court of appeal decided to leave the appeal of GOU OGLE unsatisfied, and, accordingly, the decision of the Economic Court of 03.02.2009 remained unchanged.

    The defendant in this lawsuit was the company Hostmaster, which the court ordered to terminate the delegation of the domain name www.google.ua to LLC GOU OGLE.

    On Friday, the situation received an unexpected continuation. Hostmaster company in its official release announcedthat does not provide services to the end consumer directly and does not have any contractual relationship with the defendant - LLC “Go Ogle”. The scheme for the implementation of domain delegation services is a two-level scheme, according to which only registrar companies work with the end consumer.

    According to the Hostmaster, in accordance with the above, recommendations of the World Intellectual Property Organization, ICANN and international practice for resolving domain disputes, the .UA domain administrator - Hostmaster cannot act as a defendant in a lawsuit by Google Inc.

    That is, it turns out that the Hostmaster actually plays along with Go Ogle companies. I don’t think that anyone is having doubts about the reasons for creating LLC “Go Ogle”, which now controls the google.ua domain.

    The conflict could be resolved last week, and Google would get to use its domain google.ua. But cybersquatters don't give up. They still have a chance until July 16 to file an appeal with the Supreme Economic Court.
