"Yandex" rejected 70% of requests for the "right to oblivion"

    From the first of January of this year in the Russian Federation there is a law “on the right to oblivion”. The law requires search engines to delete information of a certain kind at the request of the user, without a court order. This is information that is relevant to the applicant, and which the applicant considers illegal, unreliable or irrelevant. For failure to comply with the law, the search service may face a fine of up to 1 million rubles.

    During the period of the law, 1348 people applied to Yandex with the request to remove certain information about themselves. Search service satisfiedonly about 27% of applications, refusing on all other applications. Such a high percentage of failures, according to company representatives, is connected with the inability to verify the accuracy of information on each applicant.

    Yandex employees are simply unable to verify whether the information on each of the applicants is reliable, and whether its distribution violates anyone’s rights or laws. “We warned about this even at the stage of discussion of the draft law: the law assigns to the search engines the inherent functions of the courts or law enforcement bodies. This problem is particularly noticeable when working with appeals to remove links to illegal and unreliable information, ”the company’s blog says.

    As an example, we can cite the situation when a person demands to remove a link to a site where it is stated that this person did not perform the job properly or did not return the debt. The company is simply unable to verify that it is. Therefore, the applicant is sent to court.

    Another example is the difficulty of checking “reliable, but irrelevant information” (and according to the company, about 51% of the total number of such requests). “For example, when a doctor demands to remove links to all resources with negative reviews about him. He motivates this by saying that the reviews were written long ago and the information is irrelevant. By law, the search engine must fulfill the requirement. As a result, users will find only good reviews, that is, access to some of the information will be limited, "- representatives of" Yandex "comment.

    Interestingly, most requests come to the company in the form of paper letters.

    “Yandex”, after analyzing the received requests and the difficulties of implementing their implementation, proposes to finalize the law “on the right to oblivion.” In particular, it is proposed to require the removal of references to inaccurate or illegal information without the decision of the competent authorities; add a criterion of public importance; and provide the search engines to determine the form of filing appeals.
