Internet companies have not complied with the "Spring Law" due to the lack of secondary legislation
Despite the fact that preparations for the implementation of the provisions of the “Law of Spring” went on for several months, companies that must comply with this law have not yet received the necessary acts. The documents should be spelled out ways to transfer data to law enforcement. Well, since there is no documentation, then it is simply not possible to fulfill the requirements of the law, according to RBC.
As for the law in question, it came into force on July 1 of this year. The “Spring Law” applies to all organizers of information dissemination on the Internet (ARI): instant messengers, forums, social networks, dating sites and other sites and services. At the beginning of the month, companies had to start storing user data (correspondence, audio, images and video). Shelf life - six months. All this is necessary so that, if necessary, the data could be transferred to law enforcement agencies that conduct operational search activities and ensure the security of the country.
The law does not have technical information that allows you to understand exactly how the interaction between law enforcement officers and law enforcers should take place. How and in what form organizers of information dissemination should transfer data is absolutely unclear, it is also unclear in what form and where it is necessary to store data. “How to store data is really incomprehensible,” said Irina Levova, director of strategic projects at the Internet Research Institute.
June 28 of this year was publisheda government decree that obliges information dissemination organizers to store calls and user correspondence. But there are no explanations and instructions. “No one has yet started storing data, as the last clarifying documents that will be developed by the Ministry of Digital Development are not ready, most likely by the end of summer. In this situation, there is nothing new, this is happening with many similar laws, so now we can only wait, ”said one of the sources related to the“ Spring Law ”.
In turn, Roskomnadzor also cannot disclose the necessary information in more detail. At the request of journalists in the department, they answered that the organization “is not empowered to conduct such analytical studies,” but “according to Roskomnadzor, no additional by-laws are required.”
