Yandex Receives New Claims from Gazprom-Media TV Channels

management of TV channels owned by Gazprom-Media has decided to submit to the Moscow City Court claims of a total blockade of pirated copies of TV series in the Yandex, as reported by Izvestia. We are talking about TV channels TNT, TVZ, “Super” and 2x2, and the TV series “House Arrest”, “Out of Game”, plus the show “Mystical Stories” and the animated series “Caution, Earthlings”.
In addition, the holding company is discussing with Yandex the possibility of concluding a settlement agreement on a claim on Internet piracy, writes about itTass “The submission of claims on the protection of rights to content takes place within the time limits stipulated by the law, otherwise the court decision on preliminary provisional measures will be canceled. Yandex, in turn, filed a complaint against the court’s decision to remove references to the pirated content of the Gazprom-Media TV channels. We are in the process of negotiations and we hope that we will reach a settlement agreement in the framework of the judicial process, ”the response to the relevant request says.
As for the claims, in all of them the holding asks to stop creating technical conditions that provide the possibility of placing TV shows in a search engine. The monetary side of the case is not too interesting for the holding - as compensation for violation of the exclusive right, TV channels are asked to collect 10 thousand rubles, plus a state fee of 400 rubles.
“Yandex” intends to challenge in court the requirements for complete blocking in the search results of pirated copies of serials. The company itself considers the claims to be unreasonable, as well as not relevant to current legislation.
Yandex Company Approvesthat does not post content to the network, and therefore is not able to remove it. In addition, Yandex cannot determine (automatically) the fact that content has a specific site. Thus, among the deleted links may be those where the content is hosted by the copyright holder. Most likely, due to the removal of legal content on Yandex, the resources of Gazprom Media lost some of the traffic.
Moreover, illegal content can be found on the network and with the help of other search services, on social networks and on media hosting sites.
As for the claims to the court of September 4, Yandex will appeal them in court, just as it appealed against the provisional measures taken on the basis of the statements of Gazprom-Media.
The epopee with lawsuits began at the end of August, when TNT, TV-3, 2x2 and Super TV channels submitted an application to the Moscow City Court against Yandex due to the latter providing links to pirated TV sites. After this, Roskomnadzor even threatened to completely block the Yandex.Video service in the event that pirated content was not deleted.
True, on August 30, Yandex still removed from the search some of the links to pirated content along with the content itself, on which claims arose. The media holding earlier stated that it was afraid of the appearance of new copies of “pirate”, therefore, it is considering the possibility of filing a new suit.
