Google insists on a dispute with the FAS in the court on intellectual property rights

    The litigation between Google and FAS continues. The Internet giant is not going to put up with earlier convictions and prescriptions, and is looking for ways to challenge the regulator's decision. Yesterday, January 24, the company filed a cassation appeal to the Supreme Court of the Russian Federation because of the refusal to postpone the consideration of the dispute with the FAS to the court on intellectual rights , reports TASS .

    Recall that in September 2015, the FAS found Google to be guilty of unfair competition, obliged to make changes to contracts with vendors and manufacturers of smartphones, and in 2016 fined the giant for 438 million rubles. The complaint was initiated by the Russian company Yandex.

    The violations were that Google obliged all suppliers and manufacturers to preinstall the company's application package on their free Android OS, simultaneously blocking such agreements with other software manufacturers. The company also obliged to set the default search Google.

    Of all the prescriptions of FAS, Google has only completed the notification of users about the possibility of using alternative search engines. Payment of the fine and changes to the contracts the company has not made.

    Since the first verdict of FAS, Google has unsuccessfully tried to challenge the regulator's decision in various instances. So, after the decision of the FAS to fine Google, the company filed an appeal to the arbitration courtwhich, however, was rejected. In the future, for non-compliance with regulations, FAS continued to fine Google - the last verdict dates back to 2 November.

    At the same time, the regulator refused the corporation to extend the deadlines for the previous prescriptions, and the head of the FAS, Igor Artemyev, said that they are ready to “fine Google every two weeks” until the order is fully implemented. In addition, Artemyev threatened with criminal cases top managers of the Russian representative office of the company for ignoring the decisions of the Federal Antimonopoly Service.

    According to Artemyev, Google may challenge the decisions of the FAS during the year, so the payment of fines and the execution of regulations may be delayed. The cassation complaint of Google entered the Supreme Court of the Russian Federation on January 24, no procedural decisions on it have yet been made.
