In the US, the court recommended banning the import of certain iPhone models due to violation of Qualcomm Apple patents

    This week, an interim verdict was issued in the United States on one of the cases. Judge Mary McNamara considered that Apple had indeed violated two Qualcomm patents and recommended banning the import of some iPhone models into the country.

    What is the essence of the dispute


    According to Qualcomm, Apple without permission has used proprietary technologies to develop Force Touch features and power systems for the iPhone. In total, the company from Cupertino was accused of violating six patents.

    Claims related to a number of smartphones, including iPhone 6S, iPhone 6S Plus, iPhone 7, iPhone 7 Plus, iPhone 8, iPhone 8 Plus and iPhone X.

    According to Qualcomm management, Apple owes the company billions of dollars in royalties for using patented technologies.

    What happened this week


    The United States International Trade Commission (ITC) examined two cases in parallel. In one of them, Qualcomm’s lawsuit was rejected, in the second case, the judge agreed with the arguments for the violation of two patents and recommended imposing a ban on the import of some iPhone models.

    This does not mean the final victory of one of the parties. So far, the ban has been recommended by only one judge, the final decision of the Commission will be published in July 2019.

    In addition, the United States Patent and Trademark Office conducts its own proceedings. The consideration of the issue by this department will take about another year.

    In April, the court of San Diego will host another court hearing. In the course of it, Apple’s complaint that Qualcomm violated its obligations to ensure fair pricing for licensing patented technologies that are market standards will be examined.

    Prospects


    According to analysts, even if ultimately the US authorities ban the import of certain smartphone models, this will not affect Apple's business. In favor of the company is the fact that possible violations concern only outdated iPhone models, and in the event of a ban on import into the United States, the company will simply cease its production.
