
Obtaining a work permit in the Czech Republic: the case of a dual labor card

In the comments on my last article on employment in the Czech Republic, the question arose about the legal aspects of working in the Czech Republic. In this article, I would like to delve a little into this topic and consider one of the cases of obtaining a labor card - the case of the so-called dual card. This case is of particular interest because it is more complicated than obtaining a non-dual card and there are some nuances that are often difficult to solve without the help of a lawyer. Who cares, please, under the cat.
First, I’ll explain what should be understood as a dual labor card. Dual labor card means obtaining a work and residence permit in the country. A non-dual work card serves only as a permit to stay in the country. I’ll clarify right away that the article considers the situation for a person who already has a long-term visa or residence permit. Those who are abroad submit documents through an embassy or consulate.
As already mentioned in the articleStudents receiving a bachelor's, master's or Ph.D. status have free access to the labor market. In this case, you can immediately apply for a labor card, having in your hands an employment contract with the company. However, there are situations when it is not possible to successfully complete training and receive a diploma of graduation. In this case, it becomes necessary to obtain the very dual permission.
I myself found myself in a situation of the need to obtain such a card, so I set out everything in the article based on my own experience. So, a few words about yourself. I study in doctoral studies. Due to certain circumstances, I cannot get PhD status and must complete my doctoral studies this year. For this reason, I do not have free access to the labor market and therefore I am considering the dual card option.
To obtain a card, you must first find a suitable vacancy and sign an agreement, which is the basis for living and receiving a labor card. However, there are already some nuances here. To understand the situation, it is best to consult a good lawyer who will explain all the legal difficulties and advise what steps to take to get a work card.
So, the procedure is as follows: to apply for a dual labor card, you need to conclude an employment contract for one of the special vacancies that are published on the special MPSV portal(the so-called companies - holders of an employment card, in Czech držitele zaměstnanecké karty). Here the following rule applies: if a suitable Czech candidate is not found for such a vacancy within a month, then a foreign applicant can be hired for it, and only in this case the applicant has the right to apply for a labor card.
On the search page on the MPSV portal, you can easily find vacancies in any area of interest, in a specific city and region and find positions for a particular company. Each vacancy on this portal should, among other things, have a vacancy name (Požadovaná profese) and a vacancy number (Číslo volného místa).
There is a definite job opportunity for a vacancy that has not previously been published on the MPSV portal. However, in this case it will be necessary to agree with the company that the company will post a vacancy on this portal and only after a month will it be possible to conclude an agreement and apply for a labor card. Not all companies are ready for such a step.
Secondly, you need to prepare all the necessary documents. To apply for a labor card, the following documents are required: an application form (you can download it from here ), an employment contract with a company, a residence contract (rental agreement or hostel agreement) and a nostrification of a diploma with a certified copy of the transfer. In addition, stamps worth 1,500 kroons must be purchased.

And here is a confirmation of recognition of a higher education diploma (nostrification):

Now we proceed to fill out the application. Fill the first page as follows:

In section A, check the box “požadovaná pracovní pozice je v centrální evidenci volných pracovních míst obsaditelných držiteli zaměstnanecké karty” and in the field Číslo volného místa we indicate the same position number that I mentioned above. Then, in section B, we indicate our personal data (name, surname, phone, e-mail, date and place of birth, gender, marital status, education received).
This is how the second page should be approximately filled:

In section C we indicate the data on the selected vacancy. In the field Pracovní zařazení we indicate exactly the position name from the description of the position on the portal mpsv.cz. In section E we indicate your Czech address. Nothing more needs to be completed on this page.

On the third page we only indicate information about the last long-term stay in the Czech Republic in section H (Předchozí pobyt na území České republiky delší než 3 měsíce) and passport data in section I. On page 4 we indicate the parents' data in the same way as we indicated on the application form for long-term accommodation for the purpose of training.
Documents must be submitted to the local department for migration policy and refugee affairs of the Ministry of Internal Affairs of the Czech Republic (OAMP MV ČR). After submitting all the documents, the employee will give you the number of the application for tracking the status. The maximum application review time is two months.
