"Bi-2" took his from the FAIR catalog

    The Bi-2 group took advantage of the right to prohibit the distribution of their songs on the Internet and through the court managed to remove them from the catalog of NP FAIR , a collective copyright management society. The latter, recall, operates on the basis of Article 45 of the Law of the Russian Federation “On Copyright and Related Rights”, engaged in issuing licenses for the sale of music, as well as collecting royalties from sellers in favor of copyright owners. The Style Records company , which represented the interests of Bi-2 in court, also sought to exclude songs from other artists from the FAIR catalog, but to no avail - it was not possible to prove the right to speak on their behalf.

    “Style Records” is the first company from a number of members of the National Federation of Phonogram Producers ( NFPF), which managed to defend the exclusive right to use their own works. According to its executive director Sergei Bobza, lawsuits similar to those presented by his company are now being prepared by almost all members of the NFPF. The source noted that Style Records had previously demanded the removal of Bi-2 records from the FAIR catalog, but the result was only a complication of the procedure for excluding songs. “Therefore, many copyright holders do not even try to contact the FAIR,” said Bobza.

    The position of the NFPF regarding the activities of the FAIR was formulated by the director of the federation, Alexei Ugrinovich: “From our point of view, all the activities of collective management societies do not comply with the law. The basis of a legal business is direct agreements between users and copyright holders. ”

    Russian justice, we note, has already recognized illegal online trading in music, "backed up" only by the FAIR license. So, last month, the court recognized the copyright infringers of the owners of mp3 sites delit.net and delit.ru (the plaintiff - Gala Records).
