Increased fines for using uncertified communications

    On the official online portal of legal information, on June 2, 2016, a new law was published , which amends the Code of Administrative Offenses of the Russian Federation.

    The new Administrative Code increases the punishment for the use of non-certified means of communication. Now, for such an offense, a citizen must pay a fine of 3,000 to 5,000 rubles, with or without confiscation of uncertified means of communication (Article 13.6, paragraph 1 of the Administrative Code).

    For legal entities, a fine of between 60,000 and 300,000 rubles is provided with or without confiscation of uncertified communications.

    The Code on Administrative Offenses of the Russian Federation is also supplemented by rules on administrative responsibility for using communication media in a communication network without a declaration of conformity, if the legislation does not provide for their mandatory certification, in the form of a fine on officials in the amount of 15,000 to 30,000 rubles. with or without confiscation of undeclared means of communication. For legal entities - from 60,000 to 150,000 rubles. with confiscation of undeclared means of communication or without it (Article 13.6 p.2 of the Administrative Code).

    Ordinary smartphones are not included in the list of communications that are subject to mandatory certification. Apparently, for the "gray" smartphones face fines and confiscation only to officials and legal entities, but not individuals.

    The law was adopted by the State Duma on May 17, approved by the Federation Council on May 25, and signed yesterday by the president. The law comes into force from the day of its publication, that is, from June 2. Clause 1 of Article 13.6 enters into force thirty days after the day of official publication, that is, July 2, 2016.

    The change in the Administrative Code caused some discontentfrom users who bought or were going to buy a phone in an overseas store, where its cost is sometimes 30-50% lower than the Russian one. According to some users, the amendments are aimed at lobbying the interests of the official sellers of mobile gadgets.
