The use of car DVRs in Austria is prohibited

    In case of accident or collision with police arbitrariness or irresponsible drivers, the main argument in favor of these cameras is material evidence. At least theoretically. Because in Austria, according to ARGE Daten, the use of DVRs is unacceptable.

    The local motorist has applied for permission to use "mobile video surveillance" to protect his car and "to perform due diligence prescribed by law." The Commission for the Protection of Personal Data rejected the request. At the conclusion of ARGE Daten, motorists with such DVRs can be sued. Moreover, they are fined up to 10,000 € (and in case of repeated violation - up to 25,000 €). In addition, individuals who are illegally filmed with a DVR may require compensation under civil law of up to € 20,000. There is currently no legal framework for such preventive surveillance.

    The petitioner in his statement compared shooting on a DVR with a tourist or sports video. Since the recording was to be used exclusively by the owner of the camera, he considered this to be personal use and requested an unlimited period of data storage. The Data Protection Commission found that the permanent recording of a car is essentially video surveillance, and its real purpose is to collect evidence. Therefore, a comparison with a tourist or sports video is inappropriate. Private individuals are allowed to conduct video surveillance only in places completely within their sphere of influence, for example, at home. Video surveillance in public places is allowed only to security services.
