FAS filed a lawsuit against Microsoft
The Federal Antimonopoly Service (FAS) of the Russian Federation on Thursday filed a lawsuit against Microsoft in connection with a reduction in supplies to the Russian Federation of the Windows XP operating system!
The corresponding notice is posted on the website of the antimonopoly authority of the Russian Federation.
Here is the main excerpt from it:
“Signs of violation of antitrust laws by Microsoft are seen in the economically or technologically unreasonable termination of production and delivery to the territory of the Russian Federation of operating systems (OSs) for personal computers (PCs) of the Microsoft Windows family of boxed versions - Windows XP distribution kits and reducing the supply of this OS as a pre-installed one when selling a new computer, as well as in setting different prices for the Windows XP OS.
In order to implement measures to prevent and combat violations of the antimonopoly legislation of the Russian Federation in the field of information technology, the FAS Russia considered the situation on the software market.
As a result of the analysis of the market of proprietary (proprietary software products, where the copyright holder reserves the monopoly on their use, copying and modification, and the source code for these software products is protected by copyright), operating systems for PCs have established the dominant position of Microsoft Corporation in the market under study.
Being the sole copyright holder of the “boxed” and OEM versions of the Windows XP operating system, Microsoft Corporation in an official letter confirmed the decision to stop retail sales of this product from June 30, 2008.
The results of the analysis of the dynamics of the presence of various OSs show that the transition to the new Windows Vista OS occurs with continued demand for the previous Windows XP OS.
The presence of demand for boxed and pre-installed versions of Windows XP is also confirmed by retailers and the number of orders in the field of public procurement. ”
