Stream TV under a bureaucratic threat

    July 13 from the press center of the Office of the Federal Service for Supervision of Communications (Rossvyaznadzor) received a message that during the audit revealed a violation in the activities of MTU-Intel . The essence of the violation is the broadcasting of television programs under the Stream-TV brand without the necessary license. It is indicated, in particular, that the company has not received a license for the provision of “communication services for cable broadcasting”.

    MTU-Intel issued an order to immediately eliminate the violation of the legislation on communications, and the protocol on the case was sent to the court, which will consider the incident as an administrative offense.

    Turning to the law “On Communications”, Rossvyaznadzor points to paragraph 1 of Article 29, according to which, the provision of services for the provision of communication services is carried out only on the basis of an appropriate license. According to the state agency, the lists of services and licensing conditions contain a description of the service corresponding to the essence of Stream TV, namely, a description of “communication services for cable broadcasting”.

    At the same time, Rossvyaznadzor draws attention to the fact that the need for licensing is not related to specific technologies. It does not matter what is used - a coaxial cable or fiber optic, two-wire line or four-wire - a license must be. If "paid" services are provided in its absence, then this is illegal business.

    At MTU Intel, apparently, they were not ready for such a turn of events. Yevgeny Ryabovol, company spokeswoman, told Habrahabr that it takes some time to determine a behavior strategy, which will take to clarify all the subtleties of the issue. “We received the verification certificate of Rossvyaznadzor and the order only last night,” says Eugene. - Now the company's management and lawyers are studying the situation. “We need to study it very carefully before deciding on further actions, since this case is a precedent, the outcome of which can affect the existence of promising developing industries - IPTV, mobile TV.”

    He added that for the year that has passed since the start of Stream TV, no claims were made by Rossvyaznadzor of the company.
