At the end of October, I received a letter in my corporate mail with the strange heading “I think you will be familiar”:
“www.birich.ru I am ashamed that these are colleagues from the Saratov region ((”
Following the link I was blinded. Our client’s site flaunted before me , the company “KirovCherMet”, which we handed over at “ Nine mornings ” in the winter of 2009. This was not the first time that we were faced with the “borrowing” of our design elements or layouts. Last time, guys from hellodesigners.ru . But for us it was a revelation that insolence has no limits. The site irich.ru was not altered anything. Even the content (the license of "Kirovchermet") remained at the site vile chameleon.
At this moment, we decided to start our small but very proud investigation.
The company’s website birich.ru listed copyrights of the Saratov company Master Site . As the girl answered on the phone, their programmer was involved in this site. It was not easy to find him - with his full name and surname, he appeared in only one place. It was only later that we realized that “Ch. programmer ”Eugene and IP Ivkin - this is one person. With a nickname, for example, he was found on one of the social bookmarking services with one link to some kind of porn (not very, by the way), but for us now it doesn’t matter.
In parallel with this, we called the numbers that were indicated in the contacts on the website birich.ru. The numbers belonged to a certain company, Lomprom Saratov. The guys said (or pretended) that they didn’t know themselves in the Very Explicit Christmas Tree-Sticks of Big Wonder. They promised to figure it out. We also considered it necessary to inform our customer about this, who was so angry that he wanted to jump into his Astartmartins and jaguars and ... go to Saratov. They calmed down and began to think over what to do next.
1) Calm down and exhale
2) Go and buy bread to really calm down.
3) Make certified screenshots at a notary public.
4) Write a pretrial claim. Better with a lawyer. You can see our complaint here
5) If you know any information about the offender (name, address, etc.), go to the website www.nalog.ru . There is access to the IP / LLC database.
6) Based on these data, send a registered letter with a pretrial claim.
7) Go to the Russian Post website and get mad that their tracking is updated every 2-3 days.
8) When a notification appears on the mail site that the letter has been delivered to the addressee, call back and remind you that the person has 10 days to submit this letter to the letter.
9) If all your requirements are met, sit satisfied, if not, go to court. The court passes at the place of residence of the defendant.
All our requirements, in essence, were satisfied. The Birich.ru site no longer works, the Master Site company removed it from the portfolio. Ivkin Eugene is not going to give the amount that was recorded in the pre-trial claim, referring to the fact that he does not have money, and he is currently liquidating the IP. However, if legal proceedings have been started in relation to IP, it cannot be closed.
What will we do next? Nothing. We don’t want to go to Saratov and begin legal proceedings. We sincerely believe that Boy Eugene realized his mistake. And money? And web developers earn money differently.
