Hi Giktayms! I want to note right away that I tried very hard to avoid political issues, but since working as an individual entrepreneur is also about taxes, and taxes are about the state, there is a bit of politics in the post, sorry. Let's get started.

For the past 7 years, I, like many here, have read Habr (and now Giktayms), and usually I was able to cope with impulses to cut another post, and bright ideas were safely sent to the warehouse, from where they never returned. But a few weeks ago, everything changed. I read a wonderful post entitled “If instead of applying for a job they suggest opening an IP”, and now I can’t be silent. And so, let's figure it out what hooked me so ...

The main thing I want to convey in this post is that when you open an IP, you don’t get away from taxes (do tax employees read Gictimes?), But in fact, whether you want to or not, become an individual entrepreneur, with all the pros and cons of this concept.

Perhaps I'll start with the cons:

  1. IP is responsible for all of its property. Yes, this is true, and in this place we can return our heads to warm sand, or understand that you will establish the scope of this responsibility as an individual.

    I’ll explain - let’s say, as I. I. Ivanov, you conclude an agreement with Romashka LLC, according to which you perform work for them, write a software module, and if the agreement says that the planned date of module availability is 12/31/2016, and for each day delays you pay a penalty of 30% of the contract value, and the maximum amount of the fine is not limited, then yes, you’ve got and your apartment may be, if it is 100% owned by you and it does not contain minor children, it will go to LLC “Chamomile” by the court, but if you read the contact before signing it, and correct If this item is fined 0.1% per day, and the maximum amount of the fine cannot exceed 10% of the contract value, then everything starts to look different.

    In fact, other contracts are signed with individual entrepreneurs. As a rule, the head of Romashka LLC understands that you are not ready to work until the end of the year without money, and you agree (you are an entrepreneur, and negotiations are now part of your work) that you provide consulting services to his company on a reimbursable basis, for 5 rubles per day. There are practically no fines in such agreements, then think for yourself.

    There may be fines from the tax (for non-submitted statements, or for late payments), but guided by such considerations, it’s better not to sign anything other than an employment contract in life - this is dangerous! For example, if you sell your car and don’t pay taxes, then the tax may issue you a fine, and you will be surprised, but such a fine is unlimited! In fact, the law simply spells out the methodology for calculating it. Okay, we figured out the liability of the individual entrepreneur and fines, it will be easier on.
  2. I will not have a hospital / vacation / seniority / slippers / wheels for hamsters. Yes it will not. You are now not a worker, but an individual entrepreneur, have you forgotten? So what should I do?

    Vacation - calculate your annual income based on the fact that you will work not 12, but 11 months. I will give an example at the end of the article.

    Insurance, business phone, slippers and everything that you lose in comparison with your current place of work - include compensation in the amount of annual income. At the same time, I urge you to do it honestly - if you don’t have a company car now, then turning on compensation for it is ugly. I can simply say about insurance - if you are under 30, there are no children and chronic diseases, then you do not need it. In other cases, it must be considered.

    Work experience - well, in the first place, the entrepreneur actually pays for himself in the PFR, and in the second, google about “freezing pension savings” and draw conclusions.
  3. If the contact is terminated with you, then you will receive what is provided for by the contact in this case. For someone it's 280 million. Rub., But nothing to someone. As a rule, a normal contract spells out a two-week notice before terminating it. And how much can I reduce the full-time employee?
  4. Theoretically, " The contract of the company with individual entrepreneurs can be recognized as labor and additional taxes ." In order to avoid this, you must carry the reports to the tax yourself and render services to more than one counterparty.

Probably the cons ended there, now the pros:

  1. Self-awareness. This is probably subjective, but when you get paid for the day, the world becomes very understandable - you have worked, received, not worked ... And you finally understand why you go there and what you do there.
  2. Money. You did not think that IP is just like that? In practice, if you work as an individual entrepreneur, then it is normal to receive 150% of the level of payment for a full-time employee in a similar position, and if it comes to performing temporary work, after which you will no longer need your services, then you can increase the request to 200% or more Look at the circumstances, now you are ... well, you understand me! It should be understood that this is not an attraction of unprecedented generosity, but mutually beneficial cooperation.
  3. Time. I have a familiar engineer, who basically does not work in the summer, but prefers to earn in the remaining 9 months. But he has a narrow specialization, a sea of ​​positive reviews and many who want to work with him.

I guess I can write as much more on this subject, but I hope the basic idea is clear to you - becoming an IP you have more freedom and more responsibility, and if you are confident enough in your abilities, then consider it maybe it's worth it?

Promised example:
Now you get 100r / month, you have VHI and a phone. How much to ask as an IP?
Everyone decides for himself but my IMHO (100 * 1.5 * 12 + (70 + 0.5 * 12)) / (11 * 0.94), where 100 * 1.5 * 12 - everything is clear (1.5 I want to get 50% more, 12 - months), 70-VHI, .5 * 12 - telephone. And all this for 11 months, /0.94 is a compensation of 6% tax. It turns out ~ 180r / month. In my experience, if you succeed, then the first couple of years you will save on vacation, but then decide that health is more expensive. The figures are approximate, taken from the ceiling.
