Apple sues $ 5 million for deliberately slowing down iPhone 4S on iOS 9
Apple proudly claims to support older versions of the iPhone, despite new releases, however, is it really what the apple company promises? Plaintiff Chaim Lerman, who filed a class action lawsuit against Apple at the New York District Court on Tuesday, believes the company will knowingly release updates slowing down older versions of the iPhone so users can buy new phones.
Lerman and more than 100 people are demanding that the company pay $ 5 million for the damage caused by such a policy. A triple increase in this amount is possible. The company is accused of unfair competition and misleading customers, because of which the expectations of iPhone 4S owners were deceived after updating to the latest version of iOS 9.
“The update significantly slowed down the work of their iPhone and prevented the normal use of devices, as a result of which the plaintiffs faced a difficult choice: to use slow and buggy devices (which obviously interferes in everyday life), or spend hundreds of dollars to buy a new phone. Apple has advertised to the public that iOS 9 is compatible with and supports the iPhone 4S. In addition, the company did not warn the owners of the iPhone 4S that the transition to a new version may or will slow down the operation of devices. ”
The plaintiffs claim that the update caused “problems in the work of all aspects of the iPhone’s functionality, in particular, the basic functions, such as mail, text messages, contacts, etc.”, it is also noted that after switching to a new version of the OS, the phone often freezes . In addition, the company is accused of Apple depriving users of the opportunity "after installing iOS 9 to move to the previous, more stable version of the system."
